中共政权在中国对食品的非法征税情况

 概念框架:中英增值税税率差异原因

        这种差异的原因与英国税法是英国人以透明公开的程序选举产生的议员公开辩论表决通过的不无关系,并且每年的财政法案也要由英国议会辩论通过,确定是否需要调整税率、免征额等方面。而中共国增值税税率每次调整均未通过全国人大常委会立法辩论,增值税到现在都未能完成全国人大立法,还是按暂行条例收税,本来全国人大及常委会就是伪民意代表机构、橡皮图章,人大代表选举没有任何透明公开的选票印制、发放、投票打勾、投票人身份验证、监票、计票等流程,并且全国人大代表候选人是中国共产党预定、筛选过的,根本代表不了民意,媒体也不自由,人大代表无法自由发言,包括不能自由在X或推特发表观点,非中共预定的人大代表竞选人遭到打压,无代表不纳税,中共收的任何税都是非法的。

2020618日,中共两个央企中国化工集团有限公司(China National Chemical CorporationChemChina,简称 “中国化工” )与中国中化集团有限公司(Sinochem Group,简称 “中化集团” )进行资产重组,在中国化工下面设立全资拥有的先正达集团有限公司(Syngenta,香港注册),试图通过央企全资子公司先正达集团垄断全球的农药和种子市场。本文将通过分析中国化工、中化集团旗下上市公司及中国食品供应链中的其他上市公司的年度报告揭露中共通过对食品非法征收的苛捐杂税,对中国老百姓掏胃,中国共产党是真正的掏胃党。在开始讨论之前,先建立一个整体认知:

1.食品为农业生产者销售的自产农产品,由于免征增值税,食品消费者的支出=农业生产者收入=农业生产者净利润+种子农药等农资产品成本+人工成本+运费、油费、电费等其他相关成本,

农资产品、运费、油费、电费等采购成本

=增值税+供应商营业收入

=增值税+营业成本+税金及附加+所得税费用+销售费用+管理费用+财务费用+减值损失+公允价值变动损益-投资收益+营业外支出-营业外收入+净利润。

2. 在消费环节,食品不免增值税,食品消费者的支出=增值税+营业收入=增值税+营业成本+税金及附加+所得税费用+销售费用+管理费用+财务费用+减值损失+公允价值变动损益-投资收益+营业外支出-营业外收入+净利润。

根据中共中纪委网站的一篇文章,

200611日,《中华人民共和国农业税条例》正式废止,…1958年,《中华人民共和国农业税条例》颁布,采用地区差别比例税率,规定全国平均税率为常年产量的15.5%,最高不得超过25%。很多农民回忆,每年夏秋农作物收获时,农村家家户户便开始准备交“公粮”据统计,从1949年到2005年的57年间,全国累计征收农业税约4200亿元。[1]

可见中共从1949年到2005年对中国农民征收了57年农业税,上面提到的金额“4200亿元” (除非明确标注,本文所用货币计量单位为中共人冥币)肯定是按扭曲的价格计算的,因为在中共统治下,中共国从来没有出现过自由公平交易的农业产品市场,价格是被扭曲的。网易网站一篇文章显示,到2000年的52年间,共匪收了农业税7000多亿公斤粮食。[2]

据美国之音网站报道,河南省信阳地区1959年的粮食产量有20多亿斤,但是却虚报为72亿斤[1]。按1958年中共国务院定的河南省农业税税率15%计算,收了农业税10.8亿斤,实际剩余粮食9.2亿斤,由于上述税率未考虑地方附加以及共匪官员实际征收过程中的滥用权力另外多收情况,因此实际税负率不低于54%10.8/20×100%)。 美国之音另外提到信阳“农民全年的口粮就只剩下100多斤,仅够吃三、四个月的。”从这里也可以看出中共为何在各个领域都要进行数字造假以及数字造假的严重后果,无论是中共所谓国企的财务造假,还是中共病毒感染数据造假,中共病毒疫苗事故率造假,失业率数据造假,。据上述美国之音文章,“信阳事件”造成至少100万人死亡。

上述报道有个缺陷是没有分析中共农业税的税制缺陷。在英国,对个人收入实行综合计税制度,商业利润、工资薪酬、出租收入等分别计算应纳税所得额后再合并计税,低于年度免征额的免所得税,可见如果将该制度运用于中共农业税,粮食产量少的农户就不用交农业税。但是中共的征税权本身是非法的,不尊重任何人的财产权和生命权,不会考虑这种人性化制度。

那么农业税之后,中国共产党就不再对食品征税了吗?

据网易报道,农业税免除后,农民除了面临教育乱收费,计划生育乱罚款,农资价格大涨价等问题以外,还面临增值税等间接税,中共税务总局副局长许善达曾指出,据初步测算,中国农民在购买生产资料等生产过程中交纳的增值税,每年在4000亿元至5000亿元之间。根据中共的增值税暂行条例,农业生产者销售的自产农产品免征增值税,用于免征增值税项目的的购进货物、劳务、服务、无形资产和不动产所负担增值税不得从销项税额中抵扣,而农民不是一般纳税人,没有销项税额,如果农产品销售方有销项税额,那么购买农产品的消费者也是最终的增值税负担方;农民实际负担的税收不仅仅包括增值税,农资产品销售方的其他税费支出来源最终也是对农民的农资产品销售收入。

        食品销售企业的税费

以一家餐饮、食品加工为一体的上市公司西安饮食股份有限公司2020年年报(饮食年报)来说明消费者食品销售环节所含税费。[1]西安饮食所拥有的餐饮业务包括但不限于西安饭庄、同盛祥饭庄、老孙家饭庄等,主要经营主要经营凉菜、热菜、牛羊肉泡馍、葫芦头泡馍、水饺、烤鸭等;食品加工业务的产品主要分为糕点烘焙类、肉制品类、速冻食 品类、方便食品类。

2020年年报93页披露了西安饮食的税种及税率,如下图:

西安饮食的食品加工业务所生产的陕西特色蒸碗、黄桂稠酒、酱卤制品、中秋月饼、端午粽子、特色糕点、速冻水饺、五一大包、袋装方便牛羊肉泡馍等通常按该图列示的13%税率征收增值税,如果消费者直接从该公司购买并开了发票可以看到增值税税率为13%,但是销售渠道主要是KA商超、BC连锁超市、线上销售、经销商等,因此消费者从超市购买上述产品时索要发票,可以看到增值税税率为13%,但是201941日前该类产品的增值税税率为16%201851日前17%。餐饮收入的增值税税率为6%,购进农产品可以计算扣除增值税,还可以抵扣购进其他原料、固定资产发生的增值税,但是消费者就餐成本包含所有的增值税。食品加工和餐饮收入的小规模纳税人征收率为3%,但是购入产品时所含有增值税不能抵扣,就会计入食品销售、餐饮服务成本,提高实际售价,买单的还是消费者。93页也列示了其享受的税费优惠政策,但是提到的中共病毒疫情期间适用免征增值税政策,其本质和小规模纳税人的低征收率一样,不能抵扣或退还用于免税项目、简易计税项目的购进材料、服务、设备等价款含有的增值税。

饮食年报131页列示2020年西安饮食发生了城市维护建设税、教育费附加、房产税、土地使用税等。根据中共的《教育法》第58条,教育费附加主要用于义务教育。[1]可见义务教育的经费来源来自税收,由消费者承担,可恨的是中共用义务教育来给消费者自己和消费者的父母、孩子洗脑,宣传爱国就是爱党,明明中国共产党非法征税用于欺压、欺骗中国人民,中国共产党自己已经叛国。

饮食年报110页、112页、114页、116页、118页列示其2020年年末固定资产、在建工程、土地使用权无形资产的原值、长期待摊费用、其他非流动资产的余额分别为4.84亿元、3.07亿元、0.29亿元、0.62亿元、0.62亿元,固定资产包括房屋建筑物、办公家具 、电子设备、运输设备等,房屋建筑物、办公家具、电子设备、运输设备、在建工程、长期待摊费用、预付工程款、预付租赁款成本包括材料成本中所含有的资源税、消费税、车辆购置税、关税、所得税等税费,消费税分为针对乘用车、涂料、实木地板、汽柴油、烟酒等征收的消费税,土地使用权成本包括但不限于契税,非流动资产的成本所包括税费通过折旧与摊销列入利润表的营业成本、销售费用、管理费用、非流动资产处置损益等项目,成为消费者的支出即销售方的营业收入所需要覆盖的内容,从现金流量表来看,含有税费的非流动资产投资导致的现金流出最终需要通过消费者带来的销售商品、提供劳务所收到的现金扣除经营活动所产生的现金流出后覆盖(对于消费者购房来说这种投资来说,含有共匪苛捐杂税的房地产投资所导致的现金流出需要消费者产生的若干年现金流入扣减现金支出后的净额覆盖)。

饮食年报132页显示其在管理费用列支中共病毒导致的停工损失0.11亿元。

粮食流通环节的隐形税

据网易《中国粮食收购:肥了国企,坑了全民》报道, 中共对粮食实行“托市收购”,墙内粮价不是市场自行形成的,而是中共特许的收购主体,按照官定的“托住市场粮价不跌”的收购价敞开收购,不受市场供求的影响,在销售“托市收购”来的粮食时是“顺价销售”,即以收购价格为基础,加上“合理费用”和“最低利润”形成的价格进行销售,收购主体粮食的库存损耗浪费、甚至粮食党企的贪污舞弊损失等“沉默成本”和仓储管理费等支出,都会在拍卖时被加诸于粮价上,拍卖价将远高于托市价甚至市场价。这样层层加码,中国消费者为国产粮承担的粮价自然远高于国际粮价。所谓的“托市”高价,并不直接支付给种粮农民,而是支付给“中储粮”控制的经纪人,而中储粮的经纪人付给农民的,却是较低的农村市场流行价。[2]

笔者查询了《粮食流通管理条例》(2016年中共国务院令第666号修正本)[3]、《中共粮食收购资格审核管理办法》(国粮政〔2016207号)[4]黑龙江粮食收购资格审核规范文件(黑政发201178号)[5]证实中共实行的是粮食收购许可制度,并且规定了条件苛刻的许可证取得条件,同时在制度上给与党企垄断优势。

农产品进口关税

根据中共2020年进口产品暂时税率方案规定,对小麦等8类商品实施关税配额管理,配额内的进口按配额税率计算关税,配额外的按其他税率执行,比如最惠国税率65%,关税配额需要粮食进口企业去申请,另外粮食进口还需要缴纳增值税,船运的需要缴纳船舶吨税,进口粮食的增值税计算公式:关税完税价格*(1+关税税率)*增值税税率;因此进口粮食的成本构成:不考虑船舶吨税的进口成本+船舶吨税+关税+增值税。可见墙内自产粮食的税至少占65%,因为关税的一个目的就是为了避免进口商品的税负比国内税负率还低,压垮国内产业,不管是垄断还是高税负造成的税负,以维持高税负支持的独裁专制。2020 年粮食进口关税配额总量为:小麦(包括其粉、粒)963.6 万吨,其中 90%为共产党企业贸易配额;玉米(包括其 粉、粒)720 万吨,其中 60%为共产党企业贸易配额;大米(包括其粉、粒)532 万吨,其中长粒米 266 吨、中短粒米 266 万吨,50%为共产党企业贸易配额[6]部分粮食进口关税税率如下图:

那么知道了配额内关税税率为1-10%左右,那么这个配额占中共国年度粮食消耗量比例多少呢?非常低。根据中共粮油信息中心201912月的预测,2019/2020小麦消耗总量预计为1.235亿吨;[7]根据美国农业部统计数据显示,2019/2020年度中共国大米消费量1.45亿吨,进口量;[8]中共国2019年玉米消费量为2.76亿吨。[9]虽然中共国粮食进口看起来很低,更多和党企垄断粮食进出口贸易经营权相关,属于进口党营贸易管理的货物包括粮食(含小麦、玉米、大米)、棉花、食糖、原油、成品油、化肥等6种,垄断和党营本身就是一种税。[10]

除了大米外,化肥也实行关税配额制度,2020年化肥进口关税配额总量为1365万吨,可以推测墙内自产化肥税费占比不少于50%。其中,尿素330万吨;磷酸二铵690万吨;复合肥345万吨。共产党企业贸易关税配额数量分别为:尿素297万吨,磷酸二铵352万吨,复合肥176万吨。中化集团公司、中国农业生产资料集团公司在该类总量内申请关税配额。

        农业生产企业的税费

黑龙江北大荒农业股份有限公司2020年报(北大荒年报)第8页披露其主要生产水稻、玉米、大豆等农产品。[11]很明显北大荒是一家典型的农业生产企业,下游是消费者或食品生产商等,上游是化肥、农药等农资产品供应商,其2002年股票公开发行并上市时发布的招股说明书第58页和第65页予以验证[12]

北大荒年报118页披露其事农业项目免征企业所得税,农业生产者销售的自产农产品及农业生产资料、批发和零售的种子、种苗、农药、农机免征增值税。对该等免税项目需要注意的是:用于免征增值税项目的购进货物、劳务成本所涉及并实际支付给供应商的增值税不能抵扣或退税,需要计入产品成本,实际上还是消费者承担;农业生产者销售的自产农业生产资料免增值税不代表非农业生产者销售的自产农业生产资料也免增值税,下文提到的农资生产企业不是农业生产者,就没有披露其生产的农资产品销售环节存在免增值税的情况。

虽然北大荒年报117页和118页只披露了增值税、企业所得税、城市维护建设税和免税情况,但是152页披露其2020年发生房产税332.24万元、城镇土地使用税272.86万元。北大荒年报133页披露其2020年年末固定资产账面原值为66.72亿元,含有房屋建筑物22.80亿元,除房屋建筑物以外的其他固定资产折旧费为0.46亿元(机器设备折旧费0.38亿元加上运输工具、办公设备及其他折旧费0.02亿元、0.06亿元),北大荒年报153页披露其计入管理费用的固定资产折旧费为0.52亿元,只有用于行政管理办公用的折旧费、摊销费才会计入管理费用,说明自用房屋建筑物至少部分为办公用房,消费者间接承担了按房产余值计税的房产税,174页披露了其房屋建筑物关联租赁情况,除非免税,还会按房屋租金的12%计征房产税,出租方计入税金及附加,承租方将房产税作为租赁成本计入管理费用等科目。购建固定资产发生的材料、机械费、分包成本、间接费等成本也会负担其上游供应链厂商的铁矿煤矿资源税、车辆购置税、汽车消费税、契税等税费,最终会转入上述折旧费,由食品消费者承担该税费。上述固定资产成本也会包括间接由供应商承担的潜规则费用即隐形税,笔者在审计某重点工程项目时就发现过某合同成本项目的招标时间晚于中期验工计价时间、承包商的成立时间晚于工程结算单记录的开工时间、材料价格未按合同约定调减等异常情况。

根据《国家税务局关于检发〈关于土地使用税若干具体问题的解释和暂行规定〉的通知》(国税地字〔198815号)第十一条,免城镇土地使用税的直接用于农、林、牧、渔业的生产用地不包括办公用地,北大荒年报137页披露2020年计提了无形资产摊销费411.53万元,154页披露其无形资产摊销费用全部计入了管理费用,说明其账面的土地使用权全部是办公用地,消费者间接承担了其办公用土地发生的土地使用税。土地使用权成本一样不排除含有隐形税。

先正达旗下农药企业概况

根据安道麦股份有限公司2020年年报(以下简称安道麦年报)第9-10页,20206月,安道麦集团加入新成立的先正达集团,成为该集团旗下的独特成员。先正达集团的业务囊括了植保、种子、化肥及其它农业与数字技术,同时在中国拥有先进的分销 网络。 随着中国化工农化有限公司将其持有的公司股份划转至先正达集团,安道麦正式加入这一新生的农资 行业领军集团。而先正达集团为中国化工集团所属子公司,划转后公司的实际控制人未发生实质变化[13] 佐证了本文第一段所引用的战友做的《有关被美国制裁的中国化工集团下属全球最大的农业化工公司先正达集团的调查报告》的相关发现,同时意味着安道麦的实际控制人也是中共国资委,先正达是安道麦公司的母公司。安道麦主要从事非专利作物保护产品的开发、生产及销售,通过其遍布全球各地的约 60 家子公司向 100 多个国家的农民提供除草、杀虫及杀菌解决方案,还生产和销售 膳食补充剂、食用色素、口感及口味增强剂、及营养强化剂原料、用于香水、化妆品、护肤品及清洁 剂的香精产品、工业类产品生产。第18页显示其最主要收入来源是除草剂,2020年为117.64亿元,占总收入40%以上,其次是杀虫剂和除菌剂,收入分别为80.96亿元、58. 98亿元。

10 “集团与世界各地购买其产品的终端客户之间的产业链通常包括如下几个环节:进口商/制剂生产商->经销商->零售商->农民” 也暗示了税费如何传导到农户和消费者,也暗示食品所承担税费包括进口商/制剂生产商、经销商、零售商的税费。税费包括隐形税和显性税。

农药企业的工会经费

60页提到 “公司工会积极响应湖北省与荆州市总工会的号召,从恩施州宣恩县定点采购 22.995 万元扶贫物资” ,而工会的费用来自于企业支付的工会经费,工会经费与其他职工薪酬一并计入成本费用科目,意味所谓的精准扶贫费用由农民和消费者承担,扶贫物资的价格由中共自己决定,谁知道上面的物资采购价格是否公允、是否经过了公开、公平、公正的招标和比价程序、物资质量是否合格,谁又知道扶贫物资受益人是否为村干部关系户,或者发放后隔了一段时间又被中共村干部收回,很难说啊。因此共匪的所谓精准扶贫其实就是剥削老百姓、苛捐杂税、贪污腐败。

从精准扶贫物资支出走工会经费支出科目,可以看出中共在这方面也是用了完美犯罪套路。中共的精准扶贫通常与企业日常经营没有多大关系,通常列为营业外支出,但是列为营业外支出太显眼,就走工会经费账户。企业计提工会经费的账务处理是借方和企业经营密切相关的成本费用科目,贷方应付职工薪酬-工会经费,然后上交工会经费给中共控制的上级工会,借方应付职工薪酬-工会经费,贷方银行存款,上级工会返还一部分到企业实际控制的工会专款账户,如果企业没有实际控制工会账户,那么为何要把不相干的工会的精准扶贫活动披露为企业的精准扶贫活动,从这里也可以看出中共统治下的工会不独立,不是为保护劳工利益服务的,是共匪的走狗。

农药企业的环境成本

       安道麦年报第62页显示其主要污染物排放均 “达标” ,但是评判是否达标的也是中共政府,中共政府与该企业同受中共控制,况且中共实行的是以假治国,以贪治国,很多事情可以通过贿赂中共政府官员搞定,地方环境保护部门官位级别又不如中共央企子公司的级别高,在中共体制下实行的是下级服从上级,官大一级压死人,环评机构难以独立、客观、公正执业,中共又是中共国养老金实际管理者,社保基金理事会主任都是前任中共财政部部长,放任环境污染,可以让消费者、农民达不到退休年龄,伤害养老金受益人,减少养老金发放,怎么可能均 “达标” ?如果排污不达标,农民和消费者在承担这种假的治污成本之后,还得以承担健康风险的方式另外承担环境污染的成本。

       中共影响力活动成本

        安道麦年报第74-76页显示消费者、农户承担了中共蓝金黄、盗国集团的成本费用。安道麦公司董事长、先正达集团首席执行官Erik Fyrwald 同时是瑞士-美国商会、美国礼来公司董事,曾任美国军火商杜邦公司农业与营养部门集团副总裁;Chen Lichtenstein 先生,以色列国籍,现任董事及全资子公司 Adama Solutions 董事,先正达集团首席财务官(负责战略、整合及生产力)及其全资子公司 Syngenta AG 首席财务官,以色列民主研究中心董事和特拉维夫大学之友托管委员会成员;独立董事葛明曾任安永华明会计师事务所董事长、主任会计师,安永华明会计师事务所(特殊普通合伙)管理合伙人、主任会计师及高级顾问,同时担任中国平安保险(集团)股份有限公司、分众传媒信息技术股份有限公司及亚信科技控股有限公司独立董事,上海银行股份有限公司、苏州银行股份有限公司、腾讯公益慈善基金会监事;首席财务官兼副首席执行官Aviram Lahav,以色列国籍,之前担任Synergy电缆有限公司(曾为特拉维夫证券交易所上市公司)首席执行官,历任Delta Galil Industries Ltd.集团(以色列)首席财务官、 首席运营官、首席执行官,2000年荣获以色列年度首席财务官称号。179页显示2020年关键管理人员薪酬为0.57亿元,但是安道麦漏披露关键管理人员的构成,通常关键管理人员薪酬包括但不限于公司董事、高管。这些有巨大影响力的管理层会影响美国、以色列、欧洲等国家对先正达一系列收购涉及的经营者集中审批、国际融资、国家安全决策以及国防技术情报等多方面。

    农资及日常生活用品增值税

     安道麦年报第126页披露其2020年在中共国的所得税税率为25%,在美国、法国、以色列等国按7.5-34%缴纳所得税,增值税税率为2.5% - 27%,未具体披露中共国对其征收的增值税税率,145页披露其2020年末应付未付增值税1.66亿元,该等应付未付增值税为其销售额所含增值税扣除购进环节增值税的净额。根据从税屋网站查询的结果,农药增值税税率在不同年度不同,农药包括农药原药和农药制剂。如杀虫剂、杀菌剂、除草剂、植物生长调节剂、植物性农药、微生物农药、卫生用药、其他农药原药、制剂等等。199510月以前税率17%,先后调整为13%11%10%9%

       从上图可以看出,在中共国,除了农药以外,饲料、化肥、农机、农膜等农资产品、食用盐、食用植物油、自来水、煤气、石油液化气、天然气、图书等都被征收了增值税,税率都在9%以上,而在英国多数食品、儿童衣物、哈蕾帽(用于保护自行车、摩托车驾车人)、图书报纸等印刷物、新建民用住宅及所用建材、建筑服务、大于10人的客运服务等的增值税税率均为0%,天然气、暖气等货物的税率为5%,也比中共国低。[15]英国食品增值税税率为0%意味着,销售的这种商品所用购进的服务、材料等的增值税也会予以退还,并不是要计入产品成本由消费者承担。

农药企业间接支付的税费

        安道麦年报第152页披露其2020年发生税金及附加0.89亿元,未披露具体税种构成情况。138页披露其2020年底房屋及建筑物、运输设备原值分别是33亿元、0.22亿元,其中购进0.63亿元、0.23亿元,140页披露其2020年底租入的土地、房屋及建筑物原值4.69亿元,根据《透过房地产产业链看共匪苛捐杂税》(1[1]和(2[2]以及中共国税法,如果该等财产均位于中共国境内,可以推测税金及附加里包括车船税、房产税、城镇土地使用税等税费(2020年湖北省有减免城镇土地使用税行为,但不能报证一直持续下去,中共这种人治制度下。也不能报证事后因政敌斗争认为减免程序非法),计入当期成本费用科目的使用权资产折旧费含有租赁房产税(通常按租金12%缴纳)、业主购房时直接和间接承担的房地产相关税费(无论是否直接承担,业主的利润表都应满足等式:租赁收入=租赁成本+税金附加+所得税+净利润+其他损益),固定资产折旧费包括契税、土地增值税、车辆购置税、资源税、消费税、企业所得税、社会保险费、个人所得税等。156页披露其2020年发生当期所得税费用3.27亿元。位于中共国的农药经销商、零售商、其他农资产品的生产商、经销商、零售商不可避免的也会承担并转嫁该等税费到农户及消费者。

      化肥企业所支付税费

       安徽六国化工股份有限公司2020年报(六化年报)揭示了农户化肥成本所负担的税费。[3]六化年报第8页披露其“主营业务为化肥(含氮肥、磷肥、钾肥)、肥料(含复合肥料、复混肥料、有机肥料及微生物肥料)、化学制品(含精制磷酸、磷酸盐)、化学原料的生产加工和销售”,“主要原料为煤、磷矿、硫酸”, 98页披露化肥生产销售涉及的主要税种及税率如下图:

  上图显示,六化企业所得税税率为15%是其通过向税务局申请实现的优惠税率,而不是25%,中共国做过高新技术企业申请业务的公司都知道申请高新技术企业得另外发生费用,包括但不限于中介审计费、代理费、认定费等费用。根据本文农资及日常生活用品增值税所列示图片,化肥的增值税税率根据发生时间不同,除非很早,为13%11%10%9%,意味着农户所购进的化肥成本所含增值税在不同时间分别为13%11%10%9%,如果农户索要了发票,增值税发票上通常会显示对应的不含税价格、数量、税率、增值税税额等发票内容。但是增值税发票所显示的不含税金额实际上含有主要税种及税率所列示的除增值税以外的五花八门的税费以及其未列示的其他税费。111页披露其增值税借方余额为1.78亿元,可能是未抵扣的购进货物劳务、固定资产等支付的增值税、预缴增值税,在中共国预缴增值税通常是两种情况,税法明确规定要预缴、地方政府和地方税务部门对纳税人潜规则、土办法要求按税负率缴纳增值税(叫做超前收税或收过头税),收过头税的情况中共自己的审计公告公开披露过,但是属于中共直到被灭亡也解决不了的中共专制制度固有硬伤,农业税过头税,中共也没有根本解决过,导致了农民暴力抵抗共匪农业税的事件。

六化年报第132页和137页披露了其直接支付除增值税以外的五花八门的税费,其中132页列示的税金及附加如下图:

         上图所税金及附加科目未列示六化实际支付的包括在各类成本费用种的税费,例如132页列示的2020年广告费600.18万元,含有广告经销商、代理商等支付的文化事业建设费、房产税、城镇土地使用税、车船税、车辆购置税、所得税、契税等税费。

化肥企业非流动资产相关税费

        虽然税金及附加科目列支了车船使用税,但是114页固定资产未披露自有的运输工具相关金额,说明其将运输工具错误分类列报到了其他类别的固定资产,比如通用设备,运输工具就会涉及车辆购置税、上游企业的消费税以及其他税费。12页显示其2020年发生运输费用0.97亿元,运输费用是运输公司的收入,也就间接承担了车辆购置税、汽车消费税、汽油消费税等税费。

       114115133页分别披露了2020年底房屋建筑物、在建工程结余金额为17.41亿元、0.71亿元和2020年研发费用1.31亿元,包括上游企业直接或间接支付的《透过房地产看苛捐杂税(2)》所提及的煤铁资源税、实木地板、涂料消费税等税费。

      六化年报118页披露其2020年底土地使用权结余成本金额3.39亿元,包括土地使用权取得时缴纳的契税、耕地占用税等,除非属于免契税、免耕地占用税情况,通常化肥企业办公用房免税可能性不大。

   中共病毒给化肥企业带来的停工损失也要掏胃

     六化年报136页披露其由于中共病毒发生了停工损失0.26亿元,可见中共国消费者、农户除了要承担中共病毒给自己带来的直接经济损失、人身伤害损失、亲人离去的精神损失、医疗成本等损失外,还要间接承担中共病毒给化肥企业带来的停工损失,中国老百姓是中共病毒的受害者。

 

化肥的主要原料所涉及的税费

    例如上文提到其主要原料煤、磷矿、硫酸属于资源税征税对象,该等原料的供应商及上游企业也会直接或间接支付除资源税以外的企业所得税、消费税、房产税、车辆购置税、车船税、城镇土地使用税、关税、契税、环境保护税、土地增值税等其他税费

为了了解磷矿资源税,查询了安徽省司尔特肥业股份有限公司2019年年报(司尔特2019年报),第11页披露其“依托宣州马尾山硫铁矿、贵州开阳磷矿山储量丰富的优质原料资源优势,形成从硫铁矿制酸 至磷复肥产品生产、销售较为完整的一体化产业链”,司尔特2019年报167页披露其资源税税率为7.5%。笔者查询中共贵州省当地税务机关文件《贵州省财政厅贵州省地方税务局关于全面推进资源税改革有关税收政策的通知》(黔财[2016]39号)[4],验证了其所披露的资源税税率7.5%就是贵州省的磷矿原矿资源税税率。

   司尔特2019年报197页披露的税金及附加、第201页营业外支出和所得税费用证明了磷复肥、磷矿承担了除增值税、资源税以外的其他苛捐杂税(年报第18页证明其营业外支出列支的对外捐赠含有向宁国市慈善协会捐赠0.1亿元,其2019年发生的部分税费如下图所示:

      中共种子行业上市公司有丰乐种业、大北农等,读者自己就可以通过阅读其年报,分析其营业收入、营业成本、销售费用、管理费用、固定资产、使用权资产、无形资产等项目所含有或会发生的税费,加深对食品中所含税费的理解。

购房款内容

消费者购房成本(现款)

=契税+增值税等消费环节税费+房地产开发商收入+住房维修基金等其他价款

=契税+增值税等消费环节税费+(开发商:营业成本+税金及附加+期间费用+营业外支出-营业外收入+所得税费用+净利润)+住房维修基金等其他价款。

最终消费者购房成本的去向包括:

契税、增值税等消费环节税费、土地出让金费用、土地取得环节契税、耕地占用税、住房维修基金等;

建材供应商及施工等服务商的营业成本、税金及附加、期间费用、所得税费用、净利润等;

开发商的税金及附加、期间费用、所得税费用、净利润等。

这里只讨论购房款所含税费。

以保利地产为例

首先看保利发展控股集团股份有限公司2019年年度报告(以下简称保利地产年报)。[1]

根据保利地产年报7页,保利地产是一家专注于房地产开发及销售的大型企业集团。第8页提到其融资以银行信贷为主,股权融资、直接债务融资、资产证券化等为 辅,这句话充分反映了中共房地产泡沫经济的核心手段就是资产证券化,银行信贷、股权、直接债务属于广义资产证券化。

11页提到2019年签约金额 4618.48 亿元(通常合同里载明的签约金额为不含购买方支付的契税金额,但是包含增值税。),签约面积 3123.12万平方米,据此可以看出其平均签约单价为1.48万元/平方米(值得注意的是如果保利地产和中共政府官员关系户签约,单价通常会远远低于该价格,低于的部分由其他购房者承担,这部分多负担的买价叫隐形税)。第13页显示海外片区毛利率7.63%,墙内的毛利率大部分为华南地区的39.45%,这个差异与中共强制拆迁、土地不能自由买卖、压低中国老百姓工资、无人权这种隐形税不无关系。


应交税费反映保利地产2019年年底计算应缴纳但尚未缴纳的各种税费,包括增值税、所得税、土地增值税、城市维护建设税、房产税、教育费附加、营业税等,由于其余额为-90.89亿元,反映的是2019年年底预缴税款90.89亿元。

增值税

应交税费项目中的增值税14.59亿元,根据“应交税费”科目下的“未交增值税”“简易计税”“转让金融商品应交增值税”“代扣代交增值税”等科目贷方余额填列,“应交税费”科目下的“应交增值税”“未交增值税”“待抵扣进项税额”“待认证进项税额”“增值税留抵税额”等明细科目期末借方余额应根据情况,在资产负债表中的“其他流动资产”或“其他非流动资产”项目列示;“应交税费”科目下的“待转销项税额”等科目期末贷方余额应根据情况,在资产负债表中的“其他流动负债”或“其他非流动负债”项目列示。应交增值税的计算公式为:当期过户的房屋销售、当年租金等收入所对应的由消费者买方承担的增值税额 -保利地产购买商品、接受劳务、支付费用时所承担的中共税务机关准予扣除的增值税进项税额 - 年初未抵扣的增值税额。

49页到第62页显示保利地产2019年还有开工时间在2016430日以前的在建房地产、已完工房地产的老项目,保利地产是一般纳税人,不排除部分子公司是小规模纳税人,依据中共的房地产增值税征管办法,[2]保利地产销售自行开发的这种房地产老项目适用简易计税方法按照5%的征收率计税,以取得的全部价款和价外费用为销售额,不得扣除对应的土地价款,计税公式为含税销售额÷1+5%×5%, 预售时要按3%预缴增值税,计算公式为预售款÷1+5%×3%。其他新项目,则按按照一般计税公式纳税,即(全部价款和价外费用-当期允许扣除的土地价款)÷(1+11%×11%- 当期允许扣除的增值税进项税额。但是对于消费者来说购房发票上的增值税额为按11%计算的增值税额,预售时保利地产要按3%预缴增值税,计算公式为预售款÷1+11%×3%

109页显示保利地产2019年实现了建筑、租赁、物业管理、展览、酒店等其他收入113.06亿元,实现房地产销售收入2237.31亿元。这部分已经确认收入的房地产的增值税税率、征收率分别为11%5%。自201941日起,销售建筑、不动产租赁服务,销售房地产,转让土地使用权等,增值税税率为9%,有形动产租赁服务等增值税税率13%201851日到2019331日税率分别为10%16%201651日到2018430日税率分别为11%17%,从税率调整可以看出2017年开始的爆料革命、川普税减政策对墙内增值税税率的影响。物业管理、展览、酒店分别按商务辅助服务、文化创意服务、餐饮住宿服务适用增值税税率6%。出租2016430日前取得的不动产,可以用简易计税方法, 按照5%的征收率计算应纳税额。

对于小规模纳税人按3%5%征收率计算缴纳增值税。

如果年底房屋尚未交付,2019年及以前购房人预付房款时所含的增值税会作为预缴增值税反映在“其他流动资产”或“其他非流动资产”项目,在房屋交付购房人时,再转入销项税额或简易计税科目。

不管增值税是预缴,还是按征收率计税,还是正式申报纳税时,增值税一般都不会在保利地产的利润表反映,会一并列示在销售商品、提供劳务所收到的现金流量2820.39亿元里,但是不会单独列示。消费者除非拿到了发票,一般不知道自己是否承担了增值税。有的商品即使开出的发票显示是免增值税,但是加工该商品所用原材料包含增值税,例如农民用于生产免税水果、水稻、玉米等农产品即食品的进口肥料、种子、运输服务、油料等所含增值税。这是中共非法征收增值税完美犯罪的一个具体体现。

预缴税款

预售房地产,除了要预缴增值税时,还要预缴城市维护建设税、教育费附加、营业税、企业所得税、土地增值税等,但是其他流动资产只有预缴增值税、留抵的进项税列示,而预缴的城市维护建设税、教育费附加、营业税、企业所得税明细在应交税费列示导致出现负数余额,说明保利地产税费列报不符合中共自己制定的《企业会计准则》。这种违规问题会调低资产负债率。

税金及附加218.41亿元,反映的是保利地产2019年度的营业收入中的老项目销售收入计算的应纳营业税0.10亿元、城市维护建设税7.23亿元、教育费附加5.44亿元、土地增值税193.52亿元、其他12.11亿元、尾差0.01亿元,其他包括房产税、城镇土地使用税等。

保利地产财务报表附注第40页列示了增值税、土地增值税、契税税率,未披露房产税税率



所得税

上图所得税费用列示的当期所得税费用142.85亿元,指的是保利地产按照2019年底有效的税法规定针对期利润总额505.31亿元,经过一系列调增调减后,计算得出的应缴纳给税务部门的所得税金额。递延所得税费用是对当期尚未计税,但是以后年度会参与计税的金额的影响估计数以及对以前年度递延所得税估计数的调整。保利地产财务报表附注第40页列示了企业所得税税率,

值得注意的是上图虽然显示2019年年底时保利地产集团的香港子公司的税率为16.5%,但是在2020年实施香港国安法、2021年篡改香港选举法之后,会有很多企业逃离香港,税基减少,港共政府为了还债、维持运转以及对香港人的打压态势,很可能不得不提高香港所得税税率,或者调整扣除项目,或者把香港对纳税人的属地管理改为对香港人的全球利润征税,随之而来的还会有保利地产在香港圈钱会比以前更加困难,香港会计师可能将更加难以相信保利地产的会计报表。

土地取得成本所含税费

土地增值税、企业所得税、增值税的扣除项目是按历史成本计量的,包括取得土地使用权所支付的金额、土地征用费、耕地占用税、劳动力安置费及有关地上、地下附着物拆迁补偿的净支出、安置动迁用房支出、支付给承包单位的建筑安装工程费等成本费用。耕地占用税以实际占用的耕地面积为计税依据,按照规定的适用税额一次性征收,应纳税额为纳税人实际占用的耕地面积(平方米)乘以适用税额。

契税通常在房地产企业购置土地使用权时缴纳,但是购房消费者在买房时还要按房屋价款缴纳契税,契税的计税依据为土地使用权出让、土地使用权出售、房屋买卖的成交价格,税率3%-5%

针对非流动资产征收的房产税、城镇土地使用税

值得关注的是,如果纳税人用于出租或自用的房屋是从市场购买的房屋,在承受了买房时的契税、增值税、房地产开发商承担实际已经在房款中的土地增值税、企业所得税、土地取得时的契税后,在出租环节继续按上面的13%税率、5%征收率缴纳增值税、12%4%税率缴纳房产税等税收,要么自己承担,要么转嫁给承租方,如果是自用用于经营,每年要按房产计税余值的1.2%缴纳房产税。

保利地产有自用的房屋及建筑物、土地使用权期末分别为原值83.83亿元、2.79亿元,除非属于免税的情况,适用1.2%从价按年计征房产税;开发用地、自用土地、出租用投资性房地产所占用土地,需要按年申报缴纳城镇土地使用税。

房屋建材成本的税

那么房地产开发所用建材、机械设备等是否也会含消费税、船舶吨税呢?

根据2006年保利地产首先公开发行股票的招股说明书,房地产行业对钢材、水泥、装饰材料等有较大需求,保利地产采用的技术涉及到使用德国赫丽斯新型外墙涂料、铝塑复合管、镀膜铝合金门窗、美国“科勒”节水型座便器和美国摩恩陶瓷芯片水龙头。[3]

混凝土相关资源税、环境保护税、土地使用税

塔牌集团主要产品为硅酸盐水泥和预拌混凝土。硅酸盐水泥,主要应用于高速公路、水电大坝、铁路、机场等基础设施建设以及房地产等各类建筑工程。预拌混凝土主要指由水泥、集料、水以及根据需要掺入的外加剂、矿物掺合料等材料按一定比例,在搅拌站经计量、拌制后出售的并采用运输车在规定时间内运至使用地点的混凝土拌合物,预拌混凝土主要用于各类土木工程建设。塔牌集团2019年年报191页披露了买家从该公司购入非金属矿所含有的资源税、环境保护税、土地使用税等的税率。


铁矿石资源税、资源税、环境保护税、水资源税

以内蒙古兴业矿业股份有限公司2019年报来说明铁矿资源税,铁矿石最大的用途是炼钢,钢铁的用途十分广泛,主要包括建筑工程、汽车、机械、煤炭、船舶、 石油、铁道装备与建设、军事武器等方面。兴业矿业年报152页显示铁矿资源税按照应税收入的 5%缴纳,177页显示2019年资源税金额为4594.62万元,另外还有环境保护税20.73万元、房产税1422.61万元、土地使用税332.40万元、水资源税299.39万元,180页显示其2019年当期所得税费用为5841.23万元。


煤炭资源税、水资源税、房产税、城镇土地使用税、环境保护税

以大同煤业股份有限公司为例说明煤炭买家所承担的资源税,该公司所销售煤炭广泛应用于发电、水泥、建材等行业,而水泥、建材、电力一个重要用途就是房地产建设。大同煤业2019年年报财务报表附注 36 页披露其煤炭资源税税率为8%,按应税煤炭销售额计征,财务报表附注 75页显示大同煤业计入税金及附加的税费包括资源税5.50亿元、水资源税0.57亿元、房产税0.11亿元、城镇土地使用税792.02万元、环境保护税65.66万元。


涂料消费税与关税

根据三棵树涂料股份有限公司2019年报,是一家为地产商和工程项目建设方提供“涂料、保温、防水、地坪、基材、施工”一体化的绿色建筑解决方案涂料生产和服务型制造企业,三棵树年报第145页披露其消费税税率为4%,第10页披露其2019年进口涂料13.59 亿美180页显示2019年计入税金及附加的消费税为573.62万元。[4]进口涂料的消费税计税公式:中共海关审定的关税完税价格×(1+关税税率)÷(1-4%)×4%,关税完税价格包括了船舶吨位税,从进口涂料的消费税计税公式可以看出共匪习惯性税上加税,然后三棵树将其包装后出售给房地产开发商,关税与消费税均包括在涂料成本。如果保利地产绕过三棵树、施工方直接进口涂料,一样需要按进口环节计税公式缴纳关税、消费税、增值税。施工状态下挥发性有机物(Volatile Organic Compounds,VOC)含量低于420/()的涂料免征消费税。

 

实木地板消费税与关税

德尔未来科技控股集团股份有限公德尔未来)为例说明实木地板消费税,该公司的实木地板的大客户覆盖万科、融创、龙湖、华润等房地产企业,2019年年报第124页显示该实木地板生产企业的需要缴纳的税种及税率。

德尔未来2019年报308页显示其计入税金及附加的消费税为413.36万元;计入税金及附加的房产税312.70万元,城镇土地使用税477.07万元;当期所得税费用为4732.94万元。

从上面可以看出,德尔未来所生产的实木地板消费税税率为5%,其所销售的实木地板价款不仅仅包括消费税;如果其所销售给房地产开发商或施工方的实木地板为进口,包括关税、船舶吨税、消费税,进口环节的消费税计税公式为:中共海关审定的关税完税价格×(1+关税税率)÷(1-5%)×5%2019年适用最惠国待遇的地板(税则号:32149000)关税税率为9%,对部分国家和香港实行协定税率,其中从香港进口的关税税率为0%

车辆消费税、购置税

保利地产2019年购置运输工具原值1617.99万元,除非是免税车辆,该金额包括车辆购置税、消费税;如果是进口,还可能包括关税、船舶吨位税,其中吨税的应纳税额按照船舶净吨位乘以适用税率计算;对于运输工具,还需要每年缴纳车船税。上述铁矿石、煤炭、涂料、实木地板等房地产上游企业也会用到汽车,汽车消费税、购置税等成本不可避免的会直接或间接影响房地产购买成本,汽车本身和房地产一样也是涉及中共税种比较全的行业,消耗钢材、涂料、厂房等,同样受到上述关税、资源税、涂料消费税、房产税、土地使用税等其他税影响。

为了了解中共对车辆消费税征税情况,去看一下A股上市公司北汽福田汽车股份有限公2019年报。

福田汽车生产车型涵盖轻型卡车、中型卡车、重型卡车、轻型客车、大中型客车,年报190页显示2019年计入税金及附加的消费税为1.77亿元,房产税0.82亿元,197页显示其计入当期所得税费用的所得税为0.88亿元。


如果是进口汽车,需要缴纳关税、消费税、增值税,价款同样考虑船舶吨税,其消费税计税公式类似于实木地板的进口消费税计税公式,2019年的汽车关税税率见后附税率表:


个人所得税与社会保险费

个人所得税虽然是个人按其应纳税所得额计算纳税,但是个人所得税支出来源是个人取得的收入即雇佣者的支出,包括人工成本支出、财产租赁支出、咨询费、讲课费支出等,最终体现为房地产开发商的费用和成本,而费用和成本最终列支来源是房地产开发商销售收入,即消费者的支出。保利地产年报财务报表附注 97页显示2019年末上有代扣代缴的个人所得税1.11亿元尚未支付,通常情况下,工资薪酬个人所得税按月进行代扣代缴申报,由个人按年综合申报,2019年末应付未付1.11亿元一般在2020118日就要支付。

社会保险费虽然个人要承担部分,但是个人承担部分的资金来源还是雇佣者的支出。虽然中共声称社会保险费是为个人提供福利,实际情况是领取条件非常苛刻,用尽集权手段妨碍社会保险费受益人取得保险金,包括但不限于过度缩小受益人范围、延迟退休年龄,放任环境污染、水土流失、996、产品事故缺陷等方式降低养老金领取人达到退休年龄的可能性,反对司法独立和言论自由降低保险受益人司法维权成功的可能性。与中共不同的是,西方的社会保险受益人受到法治、民主、自由、市场竞争等多方保护。虽然前文提到中共收了环境保护税,但其更多是压榨老百姓的手段,最终转嫁到房价里,老百姓为过高的房价按揭996,与环境保护关系不大。保利地产年报财务报表附注 97页显示其2019年列入成本费用的基本养老保险费3.66亿元、医疗保险1.94亿元。

 

 


 

从本文,不难看出房地产产业链就是中国共产党对老百姓敲骨吸髓苛捐杂税的产业链,一方面用资产证券化等手段不断推高房价,以实现非法征税权利益的最大化,另一方面用非法取得的税款阻止老百姓追求民主取消中国共产党的非法征税权,打压老百姓反对强拆、劣质房、烂尾房维权,维持苛捐杂税产业链。

The relationship between Moody's and Chinese Communist Party

 It was reported by Sina that Jian (Jay) Hu, (胡剑), managing director of Moody's US corporate asset securitization product rating department, joined The Chinese Finance Association (a/k/a "全美华人金融协会", TCFA) in 1999 when he was studying for a doctorate at the University of Minnesota School of Business and that he once served as chairman of TCFA. TCFA has more than 40 long-term sponsors, including Bank of China and CICC ie China International Capital Corporation. TCFA members hold important positions in Chinese and American institutions, some of whom work in the People's Bank of China, China Securities Regulatory Commission and other entities.

The activities of TCFA

From October 28 to November 1, 2010, a delegation jointly formed by the Beijing Financial Work Bureau and the Beijing Overseas Scholars Center went to New York to attend the 16th Annual Conference of TCFA. Maggie Jiang, current Chair of TCFA and Co-Chair of CSF Overseas Asset Securitization Policy Committee, Linjia Zhou, Managing Director of Zhihe Holdings, and Kristal Hou, former Chairman of the TCFA Board of Directors and Managing Director of Shanghai Alliance Financial Services Co.,Ltd, also attended the annual meeting. On 10th November 2019, the 25th annual conference of TCFA was held at the Marriott Hotel in Manhattan, New York. The annual meeting focused on four major themes, including the opportunities and challenges faced by foreign companies in financial industry in China, the opportunities and challenges faced by Chinese companies in the US market, the impact of Sino-US geopolitical relations on China's policy and the world economic and trade order, and the prospects of financial technology, artificial intelligence and big data. Craig Phillips, former adviser to Mnuchin (US Treasury Secretary during President Trump's first term),  Jing-Dong Hua (华敬东), Vice President and Treasurer of the World Bank and Former employee of the Import Division of the Foreign Affairs Bureau of the Ministry of Chemical Industry of Communist China(PRC), Russell Read, Head of International Client Business at Morgan Stanley, Li Deng, Chief Artificial Intelligence Officer of Citadel and a speaker in Peking University of PRC introduced by Zou Yuexian(邹月娴), a member of Chinese Communist Party(CCP), and Chen Xu, President and CEO of Bank of China USA, and dozens of other industry leaders from Chinese and American financial companies attended the speech. A total of more than a thousand financial professionals from the greater New York area attended the conference. During the conference, Craig Philips said that when it comes to issues involving Chinese companies investing in the United States, the government should not interfere with the flow of private funds, and if the United States formulates restrictive policies on Chinese company stocks and China formulates restrictive policies on U.S. bonds, it will undoubtedly trigger a huge crisis between the two sides. In the conference, Henry Mo ("莫恒勇" or Heng-Yong Mo), expert lecturer of Insurance Asset Management Association of China, visiting researcher of Beijing Insurance Research Institute, senior consultant of CFA program of School of Finance of Southwestern University of Finance and Economics in PRC, former director and senior global and US economic analyst of Credit Suisse and former research assistant of National Bureau of Economic Research (NBER) and current chief economist of AIG, became new President of TCFA.
